POLICY OF SELECT INVESTMENT SERVICES LIMITED ON PERSONAL DATA PRIVACY

(1) From time to time, it is necessary for customers to supply Select Investment Services Limited (“Select Investment”) with data in connection with the opening or continuation of accounts and the establishment or continuation of credit facilities or provision of financial and/or other services.

(2) Failure to supply such data may result in Select Investment being unable to open or continue accounts or establish or continue credit facilities or provide financial or other services.

(3) It is also the case that data are collected from customers in the ordinary course of the continuation of the business relationship between customers and Select Investment.

(4) The purposes for which data relating to customers may be used (whether within or outside Hong Kong) are as follows:-

(i) the daily operation of the services and credit facilities provided to customers;

(ii) conducting credit checks;

(iii) assisting other financial institutions to conduct credit checks;

(iv) ensuring ongoing credit worthiness of customers;

(v) designing financial services or related products for customers' use;

(vi) marketing financial services or related products;

(vii) determining the amount of indebtedness owed to or by customers;

(viii) collection of amounts outstanding from customers and those providing security for customers' obligations;

(ix) meeting the requirements to make disclosure under the requirements of any legal and/or regulatory requirements or court orders binding on Select Investment; and

(x) purposes relating to any of the above.

(5) Data held by Select Investment relating to a customer will be kept confidential but Select Investment may provide such information to the following parties (whether within or outside Hong Kong):-

(i) any agent, contractor or third party service provider who provides administrative, telecommunications, computer, financial, trade execution, cash, securities and/or contracts clearing or settlement or other services to Select Investment in connection with the operation of its business;

(ii) any other person under a duty of confidentiality to Select Investment including a group company of Select Investment which has undertaken to keep such information confidential;

(iii) any financial institution or dealer with which the customer has or proposes to have dealings;

(iv) any credit reference agency and in the event of default, any debt collection agency;

(v) any actual or proposed assignee of Select Investment or participant or sub-participant or transferee of Select Investment's rights in respect of the customer; and

(vi) any exchange, entity, agency, regulatory or government body in any jurisdiction if required by law or pursuant to any court orders, rules or regulations to which Select Investment is subject. In such cases, Select Investment is usually under a duty of secrecy and will not be able to notify a customer or seek his consent in relation to such release of information.

(6) There may be instances where customers elect to provide personal information to Select Investment through electronic means (such as Internet or voice recording system). Whilst Select Investment generally uses best endeavors to maintain the security and integrity of its systems, due to many unpredictable traffic or other reasons, electronic communication may not be a reliable medium of communication. Customers should take heed of such weaknesses and communicate personal information through electronic devices with caution.

(7) Under and in accordance with the terms of the Personal Data (Privacy) Ordinance (Cap. 486) (the "Ordinance"), an individual has the right to :-

(i) check whether Select Investment holds data about him and the right of access to such data;

(ii) require Select Investment to correct any data relating to him which is inaccurate; and

(iii) ascertain Select Investment's policies and practices in relation to data and to be informed of the kind of personal data held by Select Investment.

(8) In accordance with the terms of the Ordinance, Select Investment has the right to charge a reasonable fee for the processing of any data access request.

(9) This Policy may be revised, amended or supplemented from time to time by Select Investment. The most up-to-date Policy can be found in Select Investment website at http://www.selectinvestment.com.hk or available from Select Investment upon written request.

(10) The person to whom requests for access to data or correction of data or for information regarding policies and practices and kinds of data held are to be addressed as follows: -
